Brickell City Centre Sued by Neighbor Who Wants to Halt Construction

Back in November 2013, Frame Art, Inc. filed suit against Swire Properties, the developers of the Brickell City Centre. That same case is still moving through the court systems with an emergency hearing in the end of June.

The suit was filed due to Frame Art's concerns over safety, asking for City Centre construction to be stopped. Alfredo Zayden, owner of Frame Art, has his business located next door to the City Centre's construction site. Zayden says that many heavy metal objects have fallen onto his roof, and has put his employees and customers in danger.

In addition, Zayden has noted that a 30,000 pound platform is hanging above his property, with nothing in place to keep it secure or protect bystanders below.

Frame Art has asked the judge to require Swire to use an approved safety plan.Judge Norma Lindsey has proposed a court visit to the construction site in order to observe safety and other issues.

In a similar case a while back, the Related Group was sued for some of the same reasons. Debris fell on the Apollo Bank property during the construction of the 1100 Millecento property. The verdict of that case is still undecided.
